These Terms of Service ("Terms") govern your use of the HourTraderz mobile app and related services (the "Service"), operated by Upskillible Inc. ("HourTraderz," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use HourTraderz.
1. Eligibility
You must be 18 years of age or older to use HourTraderz. By using the Service, you represent and warrant that you are at least 18. We may terminate accounts we believe belong to anyone under 18.
2. What HourTraderz is — trading services, not money
HourTraderz is a community platform for trading skills and services with other local users — for example, photography for wall painting, or hair styling for a massage.
- No money changes hands on the platform. HourTraderz does not process payments between users for trades, and you agree not to solicit, demand, or arrange cash or other monetary payment from another user in exchange for a trade arranged through the Service.
- HourTraderz is not a marketplace for paid services, an employment service, or a payment processor. We do not act as a party to any trade between users.
3. Hour Bucks
"Hour Bucks" are an in-app credit used for certain features within HourTraderz.
- Hour Bucks have no monetary value.
- Hour Bucks are not redeemable for cash or any other form of money.
- Hour Bucks are not transferable between users.
Plus and Pro subscriptions and Hour Bucks purchases are billed through the Apple App Store or Google Play and are subject to those stores' terms. Subscriptions renew automatically until cancelled; you can manage or cancel them in your app-store account settings.
4. Service area
HourTraderz is in a soft-launch phase. The Service is currently available only to users located in and around Calgary, Alberta (approximately a 65 km radius). Availability outside this area is not guaranteed and may change as we expand. Matching is further limited to the radius you select within the app.
5. Your content
You are responsible for the photos, profile details, messages, and other content you submit ("Your Content").
- You may upload or share only content that you own or have the right to use. Do not post content that infringes anyone's intellectual property, privacy, or other rights.
- You retain ownership of Your Content. You grant HourTraderz a limited, non-exclusive license to host and display Your Content as needed to operate the Service.
- We may remove content that violates these Terms or our community standards, and you can remove Your Content at any time by editing your profile or deleting your account.
6. Acceptable use and safety
You agree not to:
- Harass, threaten, abuse, or harm other users.
- Impersonate anyone or misrepresent your identity, skills, or follower counts.
- Use the Service for any illegal activity or to arrange anything unlawful.
- Solicit money for trades, run scams, or post spam.
- Attempt to bypass safety, verification, or geographic features of the Service.
You can report and block other users in the app. We may suspend or terminate accounts that violate these Terms.
7. Trade at your own risk
HourTraderz does not employ, vet, endorse, or guarantee any user, or the quality, safety, or legality of any service traded through the Service. Trades and any in-person meetings are arranged solely between users and are at your own risk. We strongly encourage you to meet in public places, tell someone where you're going, and use good judgment. You are solely responsible for your interactions with other users.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, Upskillible Inc. and HourTraderz will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service or any trade or interaction with another user. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or CAD $100.
10. Dispute resolution; class-action and jury-trial waiver
To the fullest extent permitted by law, you and HourTraderz agree that any dispute will be resolved on an individual basis. You waive any right to participate in a class action, class-wide arbitration, or representative action, and you waive any right to a jury trial. Any dispute will be governed by the laws of the Province of Alberta, Canada, without regard to its conflict-of-laws rules.
11. Termination and account deletion
You may delete your account at any time from Settings → Delete Account in the app, which removes your data as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
